Terms of Service

These Terms govern your access to and use of GhostVPS ("GhostVPS", "we", "us"), the virtual private server (VPS) service available at ghostvps.shop and through our Telegram bot. By creating an account, adding funds, or deploying a server, you agree to these Terms.

1. The service

GhostVPS provides on-demand virtual private servers that are provisioned on real third-party cloud infrastructure. Servers are delivered automatically after payment, and your account can be managed through our web panel or Telegram bot. We act as a reseller and operator on top of upstream cloud providers; their availability and terms can therefore affect the service.

2. Accounts and authentication

GhostVPS does not require identity verification (no KYC) and does not ask for your real name, government ID, or a bank card. Your account is secured by an access token (and, where you choose, a Telegram link). You are solely responsible for keeping your token and credentials secret. Anyone holding your token can control your account and servers.

We cannot recover a lost token for you. Because we deliberately hold little identifying information, we have no reliable way to prove ownership of an anonymous account. Store your token safely.

3. Eligibility

You must be of legal age to enter into a binding contract in your jurisdiction, and you must not be a person or entity barred from receiving services under applicable law. You are responsible for ensuring that using GhostVPS is lawful where you are.

4. Payment, balance and billing

The service is prepaid. You add funds using Bitcoin, Monero or USDT (TRC20); your balance is credited after the payment confirms on-chain. Active servers are billed by the hour against that balance. Full details are in the Pricing page. Cryptocurrency payments are final once confirmed and cannot be reversed by us or by you; see the Refund Policy for how we handle credits and refund requests.

If your balance is exhausted, servers may be paused, locked, powered off and ultimately deleted as described in the Pricing and Refund policies. You remain responsible for backing up your own data.

5. Acceptable use

Your use of GhostVPS is subject to our Acceptable Use Policy (AUP), which is incorporated into these Terms by reference. Because we run on upstream cloud infrastructure, you must also not do anything that would violate the acceptable-use rules of those upstream providers. Violating the AUP may result in suspension or termination without refund of the offending resources.

6. Your content and responsibilities

You are fully responsible for everything you install, store, transmit, or run on your servers, and for any third-party software you deploy. You represent that you have the rights to use that content and that your use complies with all applicable laws and these Terms. GhostVPS does not monitor the contents of your server in the ordinary course and does not claim ownership of your data.

7. Service availability

We work to keep the service reliable, but GhostVPS is provided on a commercially reasonable-effort basis. We do not offer a guaranteed uptime or service-level agreement (SLA) unless one is stated in a separate written agreement. The service may be unavailable due to maintenance, upstream provider issues, network conditions, or events beyond our control. We will make reasonable efforts to communicate planned maintenance and major incidents on our Status page.

8. Suspension and termination

You may stop using the service at any time by destroying your servers and ceasing to add funds. We may suspend or terminate access to a server or account if we reasonably believe it violates these Terms or the AUP, threatens the integrity or security of our systems or upstream providers, is required by law, or is necessary to prevent harm to others. Where practical and lawful, we will give notice; for serious abuse (for example active attacks, phishing, or child sexual abuse material) we may act immediately and without notice.

9. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that data will never be lost. You are responsible for maintaining your own backups.

10. Limitation of liability

To the maximum extent permitted by law, GhostVPS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total aggregate liability for any claim relating to the service is limited to the amount you paid to GhostVPS for the service in the one (1) month preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless GhostVPS from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms, the AUP, or applicable law.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above and, where appropriate, by notice in the panel or via the Telegram bot. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law and disputes

These Terms are governed by applicable law, and any disputes will be handled in good faith. Where a dispute cannot be resolved informally, the parties agree to seek resolution through the appropriate competent forum. Nothing here limits any non-waivable rights you may have under mandatory consumer-protection law in your jurisdiction.
